Young Carers App - Privacy Statement

A new data protection law was introduced on 25th May 2018. As a result, we've updated our Privacy Notice to make it easier for you to find out how we use, process and protect your information.

Your Personal Data

What information do we need?

撸sir视频 and Bute Council will act as the 鈥楧ata Controller鈥 for the personal data you provide to us. The Data Protection Officer, who is responsible for ensuring personal data is managed in accordance with data protection legislation, can be contacted as follows:

The information we collect from you will include details such as your name, address, age, school

For the purposes of this specific service, the personal data we require includes special category information about you (also known as 鈥渟ensitive personal data鈥), specifically your health, how you feel, what support you need along with information relating to the person you are a carer for.

Why we need this information?

Your information is being collected for the following purpose(s):-

The Carers (Scotland) Act 2016 advises that all Carers, including Young Carers, are entitled to a support plan, for Young Carers this is called a Young Carers Statement. This helps the adults around you to identify how you feel about your caring role, what you do in caring role and what support you in need in your caring role.

 

We need to know this personal data in order to ensure you feel supported as a Young Carer and that any supports you receive meet your needs.

You have the right to decline a Young Carers Statement and we will not collect any personal data from you.

The lawful basis for collecting your information in these circumstances are:-

Article 6(1)(a) and Article 9(2)(h) Consent 鈥 you have given us your consent to process your personal data and special category data to enable you to have a Young Carers Statement

Article 6(1)(c) Legal obligation 鈥 processing is necessary for compliance with a legal obligation placed on the Council by the Carers (Scotland) Act 2016

Article 6(1)(e) Public task 鈥 processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Council

We are required to collect the special category information detailed above for the following reason:

Article 9(2)(h) - For the provision of social care services based on the requirements to support young carers as a result of the Carers (Scotland) Act 2016 and the completion of the Scottish Government Carers Census;

What we will do with your information?

The Carers (Scotland) Act 2016 advises that it is your choice who the information in your Young Carers Statement is shared with, eg, parent/school/social work/youth worker/doctor/mental health worker. Should you disclose information about a child protection or welfare concern it may not be kept confidential and may have to be shared with other Social Work 撸sir视频 or relevant partners

In order to provide this service to you, we will share your information with the services/agencies/individuals as agreed with you or categories of organisations listed below for the purposes specified.

All of the information we collect from you will be processed by staff in the United Kingdom.  You should also be aware that your data will be stored on servers located in within the United Kingdom; the data will not be processed outside the European Union.  We will take all reasonable steps to ensure that your data is kept securely and more information on how we do this can be requested from the Data Protection Officer.

How long will we keep your information?

We will usually keep your information for as long as we are required to do so in terms of our retention periods, after which it will be destroyed under secure arrangements if it is no longer required for the lawful purpose(s) for which it was obtained. More information on our retention policy and procedure can be obtained from the Data Protection Officer if required.

There is no automated decision making.

Your Rights

When you provide information to the Council, you will have the following rights:

to request access to your personal data 鈥 please contact the Data Protection Officer if you wish to submit a request.

to data portability, where the Legal basis specified above is i) consent or ii) performance of a contract

to request rectification or erasure of your personal data, as far as the legislation permits 鈥 please contact the Data Protection Officer and provide details of what data you wish to be rectified or erased.
